These Terms of Service ("Terms") govern your access to and use of the Aikaa CRM platform, website, and services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy.

1. Acceptance of Terms

By creating an account, or by utilizing any Aikaa CRM service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Services. If you are accessing and using the Services on behalf of a company (such as your employer) or other legal entity, you represent and warrant that you have the authority to bind that entity to these Terms.

2. Provision of Services

Aikaa CRM provides a cloud-based customer relationship management system. We reserve the right to modify, suspend, or discontinue the Services (in whole or in part) at any time, with or without notice to you. We will not be liable to you or to any third party for any modification, suspension, or discontinuation of the Services.

3. User Responsibilities & Account Security

You are responsible for safeguarding the password that you use to access the Services and for any activities or actions under your password. We encourage you to use "strong" passwords. You agree to notify us immediately of any unauthorized access to or use of your account. You may not use the Services for any illegal or unauthorized purpose.

4. Subscription and Billing

Some parts of the Services are billed on a subscription basis ("Subscriptions"). You will be billed in advance on a recurring and periodic basis (such as monthly or annually), depending on the type of subscription plan you select. At the end of each period, your Subscription will automatically renew under the exact same conditions unless you cancel it or we cancel it.

5. Data Ownership and Intellectual Property

You retain all rights and ownership to the data you input into the Aikaa CRM platform ("Your Data"). Aikaa CRM retains all rights, title, and interest in and to the Services, including all associated intellectual property rights. You grant us a worldwide, non-exclusive, royalty-free license to host, copy, and display Your Data as reasonably necessary for us to provide the Services to you.

6. Limitation of Liability

In no event shall Aikaa CRM, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Services.

7. Governing Law

These Terms shall be governed and construed in accordance with the laws, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
